Terms and Conditions
It
is essential that you read each section of these Terms and Conditions before
submitting your application. These
Terms and Conditions will form the contractual agreement between DomainNamesGB.com
(a trading name of) Legend Communications plc. Riversway House, Morecambe
Road, Lancaster LA1 2SS and complement Legend Communications’s standard terms
and conditions found at www.businessserve.co.uk/terms
Legend Communications plc reserves the right to change these Terms and Conditions
at any time without notice. It is therefore important that you check the Terms
and Conditions via our website at: (http://www.domainnamesgb.com/terms.html)
on a regular basis.
1) Definitions
1.1 “Domain Name” refers to a name which can be used for the Internet.
1.2 “Service(s)” refers to any of the following: Email forwarding,
POP3 account, POP3 with Webmail, Web Hosting, Total Search Engine Management,
and Monthly Statistics.
1.3 “Renewal” refers to the time when your domain name or services
are due to be renewed.
1.4 “We” refers to DomainNamesGB.com
(a trading name of Legend Communications plc.)
1.5 “You” refers to you, the customer.
2) Duration, Fees & Renewals
2.1 All domain names when purchased are for a two-year duration
and renew on an annual basis thereafter at the prices in force at that time.
2.2 All other services provided to be used with the associated domain name
are purchased at the prices shown at the time of purchase on an annual contract
and renew on an annual basis thereafter at the prices in force at that time.
2.3 Primarily, we accept payment for domain names, services and renewals by
Credit or Debit card. If you are unable to pay using either of these methods,
you may pay by cheque. Cheques are to be made payable to Legend Communications plc,
Riversway House, Morecambe Road, Lancaster LA1 2SS. All payments are to reference
the domain name and renewal invoice number so payments can be accurately allocated.
2.4 Domain name registrations, renewals and services will not be activated
until payment is received in full.
2.5 Legend Communications will use its reasonable endeavours to ensure that the Domain
Name, Existing Domain Name, Internet Keyword or any other Legend Communications product
will be automatically renewed after expiry of the initial or any subsequent
registration period provided always that this Agreement remains in
force up to the date of expiry of such period.
2.6 In consideration for renewal of the Legend Communications package by Business
Serve and prior to the renewal date, the Client shall pay to Legend Communications
the annual renewal fee set out in the Price List.
2.7 Whilst Legend Communications will use all reasonable endeavours to ensure that
the Domain Name, Existing Domain Name, Internet Keyword or any other Business
Serve product is renewed at the relevant renewal date, the Client acknowledges
that it is not possible for Legend Communications to guarantee such renewal and that
Legend Communications shall not be liable for any failure to renew the Domain Name
or the Existing Domain Name.
2.8 The Client acknowledges that in the event the Client fails to remit payment
or fails to instruct Legend Communications not to renew the Legend Communications package,
Legend Communications reserves the right to renew the Domain Name or any associated
Domain Names under it own IPS tag and reserves the right to change the Admin,
Technical and Billing contacts to a Legend Communications representative and that
Legend Communications will, at that point, become the rightful owner of the Domain
Name.
2.9 The Client also acknowledges that in the event the Client fails to remit
payment or fails to instruct Legend Communications not to renew the Legend Communications
package, Legend Communications reserves the right to offer an alternative domain name
to the Client if payment is received during Legend Communications’s debt recovery
process.
3) Payment Terms
3.1 Any invoices we send to you are payable on return. Failure to pay invoices
will result in domain/service suspension without further notification from
ourselves. Domain/services will not be reactivated until payment is received
in full.
4) Cancellation
4.1 Once your domain name has been registered you are unable to alter it in
anyway. If you need to change your domain name, you must process a new registration.
Unfortunately, the incorrect domain name cannot be refunded.
4.2 When your domain name and /or services are due for renewal, you may cancel
them at this stage. Please inform us of your wish to do this by writing to
us using the address above, or emailing support@businessserve.co.uk. You must
include your username and password in your correspondence for security purposes
and clearly state the domain name or service that is to be cancelled.
6) Registration
6.1 Due to the refresh rate of the Whois database, we cannot guarantee exclusive
rights to a domain name if further parties have attempted registration at
a similar time. If we are unable to register your domain name, you will be
refunded in full or offered an alternative domain name.
6.2 You should not take any action concerning your domain name (e.g. printing
of stationary) until you have received confirmation of registration as shown
on a Whois search. Please contact us should you require confirmation as this
is not sent out automatically.
6.3 Your domain name may not appear on the Whois database for up to 48 hours
after receiving your application. Please allow this time to pass before contacting
us.
7) Disputes
7.1 We shall accept no responsibility regarding domain name disputes between
you and any individual or organisation. The dispute must be resolved between
the parties concerned.
8) Technical Failure
8.1 Legend Communications plc cannot be held responsible for any losses incurred due
to technical failure, losses arising from misinterpretation of communications,
or any circumstances beyond our reasonable control including:
a) power failure and failure of telecommunications lines
b) acts of god
c) flood, fire, explosion, bad weather
d) acts of terrorism
8.2 Any disputes between Legend Communications plc and its suppliers (e.g governing
authorities, connectivity providers, domain registrars) resulting in loss of
services cannot be compensated for.
9) Web Site Content
9.1 Any content which is uploaded to our web servers must fall within the UK
government guidelines and the AUP policy as found at www.businessserve.co.uk/terms
10) Total Search Engine Management
10.1 Once you have purchased this service, it is your responsibility to provide
us with your keywords and site description in order for us to submit your
domain to the search engines. Without this information, your site cannot
be found when searching the Internet. You must also ensure that your metatags
are inserted into the head of each html page on your site.
10.2 Although every effort will be made to attain a high ranking within the
Search Engines, we cannot guarantee a top 10 position. By accepting these terms
and conditions, you understand this. The client acknowledges that DomainNamesGB.com retain the right to withdraw or disconnect the provision of service at any time without liability on its part, and without prior notice.
The client further acknowledges that DomainNamesGB.com may suspend or withdraw services as a direct result of changes in the Internet Market that are outside of the control of DomainNamesGB at any time without liability on its part and without prior notice.
11) Whois
11.1 When you register a domain name, your address and contact details are
automatically shown on the Whois database which can be found on the Internet
and are viewable online to the public. Legend Communications plc cannot be held
responsible if implications arise as a result.
12) Scripting
12.1 Although every effort is taken in order to assist clients in scripting
their web sites, we cannot be held responsible for any errors that may occur
due to incompatibility.
13) Use of E-mail servers
13.1 Legend Communications plc mail servers should not be used for sending unsolicited
email/spam. If used in this way we reserve the right to disable/withdraw
the service without notification in line with Legend Communications’s AUP
found at www.businessserve.co.uk/terms
14) Offers
14.1 Any services which are given free during our special offer periods will
need to be renewed in line with the renewal policy outlined above.
15) January 04 Free Webmail/Anti Virus & Spam
15.1 This offer is only available when a new POP3 account is purchased in January
04. This offer does not apply to service renewals or accounts purchased prior
to January.
